In Shakespeares Macbeth, there are three examples of this kind of thing: one with the witches, one with a ghost of a best friend, and one with the a few apparitions. In the first nonrational scene three old dirty hags (witches) are discussing where they should meet Macbeth to persuade him into thinking he should be the nest king. When Macbeth finally meets the three witches on the heath like they had planed, him and his best friend Banquo are there. The witches know form years of experience that people that are Thanes always want to be king some day no matter what it takes. With the witches knowing this, they make Macbeth think that he is to be king or made king by saying All hail, Macbeth, thou shalt be king hereafter!(I, iii, 50) Therefor most of what the witches say they know because the have many years of experience and wisdom under their sleeves. Banquo, knowing what the witches had said, has to be dealt with by Macbeth. So Macbeth hires a hit man to take care of Banquo, and at Macbeths dinner party all the seats are filled except for Banquos. Macbeth, feeling guilty about his best friend, starts to hallucinate and thinks he is seeing Banquos ghost in his seat. So Macbeth says to everyone The table is full(III,iv,46) and everyone thinks he is physco. Macbeth starts talking to the so called ghost that he thinks is sitting there saying Thou canst say I did it.(III,iv,50) With Macbeth saying this it lets everyone know about the guilt that Macbeth feels and some of the other people know the crime he has committed as well. In the last witch scene Macbeth wants to see some things or people that he should beware of in the future. So the witches give Macbeth the descriptive physique of three apparitions: one of a solider in battle, one of a king that is a kid, and one of a bleeding child. While the witches call the apparitions out Macbeth sees them, and again it could be a figment of his imagination or it could be because it is at night and he cant see very well. So maybe there are some things in the Elizabethan era that then could not be explained and they were considered supernatural. But now as we look back into that era we can most likely find a rational explanation for most of the things called supernatural in that day, like the witches, Banquos ghost and the apparitions. Proving Declaration of Trust and Effecting Disposition of Beneficiary’s Interest Essay Proving declaration of trust and effecting disposition of beneficiary’s interest Proving declaration of trust: In order to prove declaration of trust all types of evidence are admissible. Exceptions: a) Trust of land where the declaration has to be manifested and proved by some writing (Section 7 of Statute of Fraud Act 1677; Section 53(1)(b) of Law of Property Act 1925). The reason for this rule is to prevent fraud (Youdan). The written evidence can antedates or postdate the declaration of trust. ) Testamentary trust/trust executed after death by will (will be discussed in the chapter of secret trust). Consequence of oral declaration in case of trust of land: a) An oral declaration is perfectly valid because the section 53(1)(b) is an evidential section. b) But problem arises during litigation when the declaration is challenged. c) It is often said that, though mistakenly, without written evidence a declaration of trust is valid but unenforceable. d) This is based on an analogy with the section 40(1) of LPA 1925 but this section was repealed in 1989. ) There are two reasons for this analogy to be false: i) Section 53(1)(b) is concerned about proof and section 40(1) was concerned about enforceability as apparent from the wordings of the sections. ii) Section 40(1) had been overruled back in 1989. f) Subject guide is of the view that if a declaration of trust cannot be proved by evidence then there is no trust at all, not a valid but unenforceable one. Exceptions to section 53(1)(b): a) Common Law exception: Oral evidence can be admissible in order to prevent a fraud. For example, a trustee himself would commit a fraud if he were allowed to shelter behind the statutory provision and deny the declaration of trust (Rochefoucauld). b) This exception is only applicable in case of express trust. c) Statutory exception: The section 53(1)(b) is not applicable in case of resulting, implied or constructive trust (section 8 of Statute of Fraud Act; section 53(2) of LPA 1925). d) It is because, in case of constructive, resulting or implied trust no allegation is made as to the fact that a declaration of trust has been made and thus we need to prove it. So, when there is no declaration of trust, the need to prove it cannot exist. e) Matrimonial homes cases such as Pettitt, Gissing, Rossett, Stack are express trusts of land (Rochefoucauld) even though it is been mentioned in these cases that they are ‘Common Intention Constructive Trust’. This is a misnomer to say them CICT because a CT arises for any reason other than intention to create a trust so there cannot be ‘common intention constructive trust’. Effecting Disposition of Beneficiary’s Interest: ) Disposition of an equitable interest or trust subsisting at the time of disposition must be in writing signed by the person disposing the same or by his agent (Section 53(1)(c) LPA 1925). b) So there is no disposition until it is written and signed, the reason is section 53(1)(c) is a substantive section as apparent from the wording of the section. c) One can argue that as the wording of the predecessors of section 53(1)(b) and 53(1)(c) are similar (i. e. section 7 and 9 of Statute of Fraud Act), therefore, there should not be this difference between these two sections. ) However, the courts have taken this approach and we need to follow it. e) There is a question that whether section 53(1)(c) is only applicable in relation to trust of land. As per section 205(x) of LPA 1925 equitable interest means interest in or over land or in the proceeds of sale thereof. As such 53(1)(C) is only confined to trust of land. f) However, as significant cases like Grey, Oughtred and Vandervell were n ot cases of land but section 53(1)(c) was applied there, therefore, the best way to solve this dilemma is to say that those cases were decided per incuriam of section 205(x). What transactions are dispositions or assignments and caught by section 53(1)(c)? a) Disposition has wider meaning than assignment though disposition included assignment. b) The key to understand disposition is to understand that it only covers disposition of equitable interest. If somehow, there is no equitable interest to dispose of or if both the legal and equitable interests are disposed of then there cannot be a disposition under section 53(1)(c). ) A direction of a beneficiary to his trustee to hold the rights on trust for a third party is disposition can caught by section 53(1)(c) (Grey v IRC). d) A direction by the beneficiary to the trustee to transfer the right to a third party then there is no need to comply with section 53(1)(c) as the direction is to transfer both the legal and equitable interest rather than equitable interest only (Vandervell v IRC) e) A self declaration of trust by the beneficiary for the whole or part is disposition and caught by section 53(1)(c) (Gra inge v Wilberforce). ) A declaration of trust by the trustee for a third party with the consent of the existing beneficiary is a disposition and should be caught by section 53(1)(c) provided estoppel does not operate. If estoppel occurs as occurred in re Vandervell (No 2) and thus prevents the trustee to dispose of the equitable interest in favour of someone, then section 53(1)(c) cannot operate (re Vandervell (No 2). g) A contract by the beneficiary to assign their rights does not fall into section 53(1)(c) (Oughtred v IRC; Neville v Wilson). ) A surrender of a beneficial interest is caught by section 53(1)(c) (IRC v Buchanan). i) Disclaimer of beneficial interest is not covered by section 53(1)(c) (re Paradise Motor Ltd). The rationale of 53(1)(c): a) The purpose of this section is to prevent fraud by way of protecting the trustee from false allegation by someone to be an assignee of the beneficiary’s interest. If the trustee disposes the interest to that false assignee then he will be vulnerable to a claim of breach of trust. ) Therefore, in Vandervell v IRC, as the rights were no longer held in trust, therefore, there was no trustee to protect and as such the section had no work to do and inapplicable. c) Now, as in Grey, the trustee received the direction from the beneficiary himself and knew that it was genuine and no allegation by false assignee can deceive him, therefore, the section 53(1)(c) cannot apply there. It is because the trustee need not be protected against any false allegation here. In the light of this, Grey can be revisited.

Native American Medicine "Native American medicine is based on widely held beliefs about healthy living, the repercussions of disease-producing behavior, and the spiritual principles that restore balance." -Ken "Bear Hawk" Cohen (Chrisman 1). The beliefs that Cohen is referring to are shared by all North and South Native American tribes, however, the methods of diagnosis as well as the treatments vary significantly. This is mainly due to the fact that Native American medicine is based upon a spiritual view of life. A healthy person is someone who has a sense of purpose and follows the guidance of the Great Spirit who represented the central religious figure for most tribes (Chrisman 2). It is believed that someone is unhealthy because they have done something morally wrong, or not within their culture's boundaries of what is deemed acceptable. If the tribe member did do something wrong, often they would not receive medical treatment because it was believed that they were learning a lesson as a direct result of their actions. However, many times when an illness could not be accounted for the patient would receive medical attention. Native American medicine was administered through two primary sources, rit ual procedures and rational therapy (Vogel ix). These two sources provided working combinations that were able to cure many illnesses for several reasons. The medical practice of rational therapy was generally practiced first. It is referred to as rational therapy because actual substances, such as parts of plants and herbs, were used and often resulted in medical success. Many people do not realize how many contributions the Native Americans made in the field of medicine. They experimente... ...y due to the advances in scientific medicine, the introduction of medical insurance, free services, and the general availability of the medical care today. Also, many tribes have had to relocate to land where their valuable resources of plants and herbs may not be present. The white man adapted the native practices to administer them through the clinics and hospitals. The medicine that we practice today is a combination of Native healing practices and modern science. The vast contributions made by our Native Americans must not be overseen or forgotten. The indigenous peoples of the Americas set up the basic grounds of experimentation and administration of multiple pharmaceuticals used today.

The mistress and harp of burma

In Japanese Literature, stories have often depicted what greatly influenced the prevalent period of common life and social sentiment. In the two books written by Japanese authors in two separate periods of Japan’s history, a transition is clearly seen through literature often expressed in superb storytelling. In Ogai Mori’s â€Å"The Wild Geese†, human struggle is greatly influenced by tales of love in the midst of Japan’s industrialization boom. Writers depict and assimilate the concepts of free-thinking which brought romance and human emotion to the limelight. The familiarity of the reforms established during the period for which Ogai’s novel was actually written apparently brought forward the chance to openly discuss Japan’s so-called evil customs and traditions in a bid to strengthen the imperial rule. Okada, as one of the main characters clearly narrated how he felt that a woman should be only a beautiful object, something loveable, a being who keeps her beauty and loneliness no matter what the situation she is in (Ogai, 20). In the same page, Okada added that this sentiment is brought about under the influence of habitual reading of old Chinese love stories. There is therefore a clear view in principle that establishes a need to disregard culture and ideas that wrongly adapted the old Oriental ways which often restricted free-thinkers to intellectually prosper. Several decades later after Japan was able to stand on its own two feet, Japan experienced a wartime defeat that brought home sad stories of soldiers taken as prisoners of war. Takayama’s â€Å"Harp of Burma† showed pacifism as the main aim of both novel and on film. â€Å"We have to be ready for hardship, for all we know, we may die here in Burma. If that time comes, let us die together†¦Ã¢â‚¬ , (Takeyama, 33). Such poignant words relay veiled patriotism whose desire for peace in an armistice agreement with their British captors aims to relay the evils of war. Written during a period where wartime horrors still stayed afresh in the minds of the Japanese people, there was not an ounce of blame or an aim to proclaim the evils of their captors. Its sincere inward idea was just to dwell on the problems the war brought to everyone involved. In retrospect, The Harp of Burma establishes a deeper humanistic connection to modern day events where peace is the common desire of mankind. The movie through cinematic effect exceeds sensory reflection that somehow created a link to present day situations around the world where wars and battles are fought. Although Ogai’s novel discussed social issues on a road to recovery, the pressing need for peace exceeds in meaning and connection through the Harp of Burma that was successfully portrayed in film. Seeing the ravages of war makes a good reflection how one favors such madness that resulted in tragedy and death. As an anti-war film, it even exceeded the points portrayed in its novel where suffering is presented as a result of too much desire. As a challenge to survival, the movie â€Å"Fires on the Plain† declares a clearly made manifestation of human woes compared to the movie of the same title, â€Å"The Burmese Harp†. Both movies however adapted Takeyama’s novel The Harp of Burma that depicted a deep sense of longing for the fatherland while emphasizing compassion in the midst of survival and atrocities. As a human interest film, â€Å"Fires on the Plain† arouses a relative connection through artistic performance of reality in full color for young viewers to understand how wars wreak and break even the strongest heart. The Wright Brothers and the First Flight of an Airplane In 1899, after Wilbur Wright had written a letter of request to the Smithsonian Institution for information about flight experiments, the Wright Brothers designed their first aircraft. It was a small, biplane glider flown as a kite to test their solution for controlling the craft by wing warping. Wing warping is a method of arching the wingtips slightly to control the aircrafts rolling motion and balance. Lessons From Birdwatching The Wright Brothers spent a great deal of time observing birds in flight. They noticed that birds soared into the wind and that the air flowing over the curved surface of their wings created lift. Birds change the shape of their wings to turn and maneuver. They believed that they could use this technique to obtain roll control by warping or changing the shape, of a portion of the wing. The Gliders Experiments Over the next three years, Wilbur and his brother Orville would design a series of gliders that would be flown in both unmanned (as kites) and piloted flights. They read about the works of Cayley  and Langley and the hang-gliding flights of Otto Lilienthal. They corresponded with Octave Chanute concerning some of their ideas. They recognized that control of the flying aircraft would be the most crucial and hardest problem to solve. So following a successful glider test, the Wrights built and tested a full-size glider. They selected Kitty Hawk, North Carolina as their test site because of its wind, sand, hilly terrain and remote location. In the year 1900, the Wright brothers successfully tested their new 50-pound biplane glider with its 17-foot wingspan and wing-warping mechanism at Kitty Hawk in both unmanned and piloted flights. In fact, it was the first piloted glider. Based on the results, the Wright Brothers planned to refine the controls and landing gear, and build a bigger glider. In 1901, at Kill Devil Hills, North Carolina, the Wright Brothers flew the largest glider ever flown. It had  a 22-foot wingspan, a weight of nearly 100 pounds and skids for landing. However, many problems occurred. The wings did not have enough lifting power, the forward elevator was not effective in controlling the pitch and the wing-warping mechanism occasionally caused the airplane to spin out of control. In their disappointment, they predicted that man will probably not fly in their lifetime. In spite of the problems with their last attempts at flight, the Wright brothers  reviewed their test results and determined that the calculations they had used were not reliable. They decided to build a wind tunnel to test a variety of wing shapes and their effect on lift. Based upon these tests, the inventors had a greater understanding of how an airfoil (wing) works and could calculate with greater accuracy how well a particular wing design would fly. They planned to design a new glider with a 32-foot wingspan and a tail to help stabilize it. The Flyer In 1902, the Wright brothers flew numerous test glides using their new glider. Their studies showed that a movable tail would help balance the craft and so they connected a movable tail to the wing-warping wires to coordinate turns. With successful glides to verify their wind tunnel tests, the inventors planned to build a powered aircraft. After months of studying how propellers work, the Wright Brothers designed a motor and a new aircraft sturdy enough to accommodate the motors weight and vibrations. The craft weighed 700 pounds and came to be known as the Flyer. The  First Manned Flight The Wright brothers built a movable track to help launch the Flyer. This downhill track would help the aircraft gain enough airspeed to fly. After two attempts to fly this machine, one of which resulted in a minor crash, Orville Wright took the Flyer for a 12-second, sustained flight on December 17, 1903. This was the first successful powered and piloted flight in history. In 1904, the first flight lasting more than five minutes took place on November 9th. The Flyer II was flown by Wilbur Wright. In 1908, passenger flight took a turn for the worse when the first fatal air crash occurred on September 17. Orville Wright was piloting the plane. Orville Wright survived the crash, but his passenger, Signal Corps Lieutenant Thomas Selfridge, did not. The Wright Brothers had been allowing passengers to fly with them since May 14, 1908. In 1909, the U.S. Government bought its first airplane, a Wright Brothers biplane, on July 30. The airplane sold for $25,000 plus a bonus of $5,000 because it exceeded 40 mph. Wright Brothers - Vin Fiz First Armed Airplane On July 18, 1914, an Aviation Section of the Signal Corps (part of the Army) was established. Its flying unit contained airplanes made by the Wright Brothers as well as some made by their chief competitor, Glenn Curtiss. Patent Suit Although Glenn Curtisss invention, ailerons (French for little wing), was far different from the Wrights wing-warping mechanism, the Court determined that use of lateral controls by others was unauthorized by patent law.

Weighing the Aggravating and Mitigating Factors When deciding the sentencing for a defendant who has been found guilty, jurors and the judge in most states are asked to weigh the aggravating and mitigating circumstances of the case. The weighing of aggravating and mitigating factors is most often used in connection with the penalty phase of capital murder cases, when the jury is deciding the life or death of the defendant, but the same principle applies to many different cases, such as driving under the influence cases. Aggravating Factors Aggravating factors are any relevant circumstances, supported by the evidence presented during the trial, that makes the harshest penalty appropriate, in the judgment of the jurors or judge. Mitigating Factors Mitigating factors are any evidence presented regarding the defendants character or the circumstances of the crime, which would cause a juror or judge to vote for a lesser sentence. The Weighing of Aggravating and Mitigating Factors Each state has its own laws regarding how jurors are instructed to weigh aggravating and mitigating circumstances. In California, for example, these are the aggravating and mitigating factors a jury can consider: The circumstances of the crime and the existence of special circumstances. Example: A jury might consider the special circumstances of a defendant that was charged with driving while intoxicated on the day that he received divorce papers and was fired from a company where he had been employed for 25 years and he had no previous criminal record. The presence or absence of violent criminal activity by the defendant. Example: The defendant broke into a home and the family inside the home woke up. The teenager in the family attacked the defendant, and instead of attacking back the defendant calmed the teen down and led him to his parents for reassurance, and then he left their home. The presence or absence of any prior felony convictions. Example: A defendant found guilty of shoplifting an expensive television might be given a lesser sentence if he had no criminal record. Whether the crime was committed while the defendant was under the influence of extreme mental or emotional disorder. Example: A woman was found guilty of assault after attacking a stranger, however, it was discovered that she was on new medication for depression which had a possible side effect of patients exhibiting unexplained and unprovoked violent behavior. Whether the victim was a participant in the defendants homicidal conduct or consented to the killing. Example: The victim hired the defendant to blow up his house for the insurance premiums, but he failed to leave the house at the time the two agreed on. When the bomb exploded the victim was inside the house, resulting in his death.   Whether the crime was committed under circumstances which the defendant reasonably believed to be a moral justification or extenuation for his conduct. Example: A defendant guilty of stealing a specific drug from a drugstore, but could prove that he did it because he needed it to save his childs life and could not afford to buy the medicine. Whether the defendant acted under extreme duress or under the substantial domination of another person. Example: A woman found guilty of child abuse suffered years of extreme abuse from her dominating husband and did not immediately report him for abusing their child. Whether at the time of the crime the capacity of the defendant to appreciate the criminality of his conduct or to conform his conduct to the requirements of the law was impaired as a result of mental disease or defect, or the affects of intoxication. Example: It would likely be a mitigating factor if the defendant suffered from dementia. The age of the defendant at the time of the crime. Example: A woman found guilty of severely injuring people when, in the 1970s as an act of political protest, she (who was 16 years old at the time) and others set off a bomb in an office building that they believed was empty. She was never caught but turned herself in for the crime in 2015. For the past 40 years, she was law abiding, had married and was the mother of three children, and was active in her community and in her church. Whether the defendant was an accomplice to the crime and their participation was relatively minor. Example: A defendant was found guilty of being an accomplice in a breaking and entering case after it was learned that he mentioned to the co-defendants that the people who owned the home were away on vacation. He did not participate in actually breaking into the home. Any other circumstance which extenuates the gravity of the crime even though it is not a legal excuse for the crime. Example: A male teen, 16 years old, shot and killed his abusive step-father after finding him in the act of sexually molesting his 9-year-old sister. Not All Circumstances are Mitigating A good defense attorney will use all relevant facts, no matter how minor, that could help the defendant during the sentencing phase of the trial. It is up to a jury or judge to decide which facts to consider before deciding on the sentence. However, there are some circumstances that do not warrant consideration. For example, one jury might reject a lawyer presenting the mitigating factor that a college student found guilty of multiple charges of  date rape would not be able to finish college if he went to prison. Or, for example, that a man found guilty of murder would have a hard time in prison because of his small size. Those are circumstances, but ones that the defendants should have considered before committing the crimes. Unanimous Decision In death penalty cases, each juror individually and/or the judge must weigh the circumstances and decide whether the defendant is sentenced to death or life in prison. In order to sentence a defendant to death, a jury must return a unanimous decision. The jury does not have to return a unanimous decision to recommend life in prison. If any one juror votes against the death penalty, the jury must return a recommendation for the lesser sentence.
